The deadline for notifying employees their “zombie agreements” are being terminated is fast approaching.

Zombie agreements — registered enterprise agreements pre-dating January 1, 2010 — will automatically cease to have effect from December 7, 2023, unless extended.

Employers must give written notice to each employee covered by the affected agreement that the agreement will sunset, including information about the timing and the FWC’s role in extending the default period.

Employers must provide the required notice by no later than June 6; failure to do so is a breach of a civil penalty provision.
